This website (hereafter this “Website”) is made available by Bottlers Nepal Limited, a company incorporated in Nepal under the laws of Nepal (hereafter “BNL”). This Website is offered to you (hereafter the “User”), conditioned on your acceptance of these Terms and Conditions of Use. If you do not accept these Terms and Conditions of Use, please exit this Website.

1. Use of this website

The Website has been prepared and compiled by BNL, in good faith and solely for the purposes of providing information about the business operations and initiatives of BNL and the career and business opportunities available with BNL.

BNL authorizes the User to view the content available on the Website. The User is not permitted to copy, replicate, modify, distribute, display, perform, create derivative works from, transfer or sell any information obtained from this Website, whether in printed, visual or electronic form, for any purpose whatsoever, without the prior written permission, at the sole discretion of BNL. As a condition of User’s use of this Website, User warrants that he/she will not use this Website for any purpose that is unlawful, prohibited or not expressly permitted by these Terms and Conditions of Use. While accessing and viewing the contents of the Website, the User agrees to comply with all copyright laws existing worldwide and to prevent any unauthorized copying of any of the content available on the Website.

User agrees that any unauthorized or unlawful use of this Website, or any contents thereof, would result in irreparable injury to BNL and/or its affiliates for which monetary damages would be inadequate, and in such event BNL and/or its affiliates, as the case may be, shall have the right, in addition to other remedies available at law and in equity, to immediate injunctive relief against the User and/or criminal prosecution. Nothing contained in these Terms and Conditions of Use shall be construed to limit remedies available pursuant to statutory or other claims that BNL and/or its affiliates may have under separate legal authority.

The Website features logos, brand identities and other trademarks, service marks, trade names, slogans, logos, and other indicia of origin (“Marks”) that are the registered trademarks of The Coca-Cola Company as the case may be. Nothing contained on this Website should be construed as granting, by implication, estoppels or otherwise, any license or right to use any Mark displayed on this Website without prior written permission (at the sole discretion) of BNL or any such third party that may own the Mark, displayed on the Website.

User’s registration data and other information about the User collected through the use of this Website is subject to BNL’s Privacy Policy available at www.bnl.com.np. User acknowledges that through his/her use of this Website, User consents to the collection and use (as set forth in the Privacy Policy) of his/her information, including the transfer of his/her information to governmental authorities for storage, processing and use by BNL and/or its affiliates.

The User agrees to defend, indemnify and hold BNL harmless from and against any and all claims, damages, costs and expenses, including advocate’s fees, arising from and related to User’s access and use of the Website.

The User hereby agrees not to establish a link of the Website on third party website, for any purposes whatsoever, without the prior written permission of BNL.

User hereby consents to the exclusive jurisdiction and venue of courts in Kathmandu in all disputes arising out of or relating to the use of this Website. Bottlers Nepal Limited (hereafter “BNL”) is committed to protecting the privacy of its visitors (hereafter the “Visitors,” “you” or “your”) to our Internet world-wide website  (www.bnl.com.np) (hereafter referred to as the “Website”) that links directly to this privacy policy about the protection of personal information online. We aim for this Website to be a safe and enjoyable environment for you.

This privacy policy (hereafter the “Policy“) primarily describes:

• the information that BNL collects through the Website, which is hosted and operated from Nepal
• the use and role of cookies and similar technologies on the Website and
• the security measures BNL has in place to protect the information that BNL gathers through the Website

This Policy does not govern BNL’s collection of information through any website, or by any other means, other than through this Website, or the collection of information by any parent, or subsidiaries of BNL (“Other Entities”).

1. Information gathered by BNL through the website

BNL gathers two basic types of information through the Website: (i) “Personal Information,” information from which an individual can be identified, and (ii) “Aggregate Information,” from which an individual cannot be identified.

• Personal Information: You are not ordinarily required to register or provide Personal Information in order to access the Website, though certain functionalities such as participating in any consumer promos, contests, etc., may require registration. BNL collects Personal Information from you only when you voluntarily provide it to BNL – for example, in contacting BNL through the Website, filling in the form for applying for a vacancy or while requesting for a visit to the manufacturing plant of BNL, or exploring business opportunities with BNL, answering surveys and polls, entering contests, sweepstakes, raffles and similar promotions, signing up for email updates and announcements concerning BNL’s products and special promotions, and purchasing BNL’s merchandise. Personal Information may include your contact information (such as your name, postal address, telephone numbers and/or email address), as well as your payment information, if required, such as credit card number and expiration date (“Payment Information”), which will be collected if you wish to purchase any product or merchandise made available through the Website (“Transaction”).
• Aggregate Information: When you visit the Website, BNL and the third parties with whom BNL has contracted to provide services, may collect anonymous information from three sources: server log files, cookies, and pixel tags.
• Server Log Files: Your Internet Protocol (IP) address is an identifying number that is automatically assigned to your computer by your Internet Service Provider (ISP). This number is identified and logged automatically in BNL’s server log files whenever you visit the Website, along with the time(s) of your visit(s) and the page(s) that you visited. 2. Use and disclosure of information gathered by BNL through the website

• Personal Information:  BNL may use Visitor’s Personal Information in any of the following ways:
  1. Communications: BNL encourages the Visitors to contact BNL with questions and comments. Personal Information may be used by BNL in order to respond to the respective Visitor’s questions and comments.
  2. Business Purposes: BNL may also use the Personal Information of its Visitors for internal business purposes, such as analyzing and managing its businesses. The Personal Information collected from the Website may be combined with other information collected by BNL via other online or offline sources, with demographic information and other information that is available in the public domain.
  3. Transactions: When you take part in a Transaction through the Website such as purchasing BNL’s products or merchandise, BNL may collect Payment Information from you related to such Transaction as well as other Personal Information such as shipping address for shipping of the ordered products or merchandise purchased through the Website. BNL may use your Personal Information or Payment Information in order to complete the Transaction and, if applicable, to fulfill your purchase. The Payment Information may also be shared with the third parties, as may be necessary, to complete your Transaction (for example, to process the payment made through the credit card).

Critical Communications: BNL may from time to time and as may be necessary use your Personal Information to send emails consisting of important information regarding the Website, your Transactions, or for notifying any amendments or modifications to the terms, conditions, and policies of BNL with respect to use of this Website (“Critical Emails”). Since Critical Emails would consist of important information you shall not have the option of not receiving Critical Emails.

Third Party Service Providers: BNL works with third parties who provide services, including website hosting, credit card processing, data analysis, newsletter services, promotional activities, and other administrative services. BNL may share your Personal Information, including your Payment Information, with such third parties, as may be necessary, for the purpose of enabling such third parties discharge the provision of such services.

• Aggregate Information:  BNL may analyze Aggregate Information in order to enhance the Website security, track the popularity of certain pages of the Website, track success of our email notifications, assess traffic levels on the Website and other usage data, all of which would help BNL to provide content tailored to the interests of the consumers, improve the Website and related services and to otherwise enhance Visitor’s experience on the Website. BNL may also share the Aggregate Information with its Other Entities and other third parties for provision of such services.

3. Other important note’s regarding BNL’s Privacy Policy

• Special Note for Parents and Children: Website and the contents therein are intended for a general audience and not intended for utilization directly or independently by children under 18 years of age. If you are a child under the age of 18 years and desire to use this Website or purchase any products or merchandise (if sold through this Website), please request your parents to complete the necessary registration formalities and complete the Transaction. Any use of this Website or any of its features by a child under the age of 18 years must be under parental supervision. From time to time, BNL may ask you to indicate whether you are interested in receiving emails and other information from BNL or not. If you elect to receive these communications, BNL will occasionally send you emails or other information that match your requests and offer you promotions and coupons.

If at any time you wish to stop receiving these email communications from BNL, you may put up a request for discontinuation of sending of such e-mails by emailing, calling or writing to BNL using the contact information provided on the Website or by using the unsubscribe feature in the email received by you. Please indicate that you wish to stop receiving email communications from BNL. However, you shall not have the option of discontinuing the receipt of Critical Emails from BNL.

The website includes a link to our Jobs section, which contains information on what it’s like to work for BNL, our mission, vision and values, and methods for applying for jobs at BNL’s offices.
